CLASP’s Statement on Birthright Citizenship and the Fourteenth Amendment

CLASP submitted a statement for record that strongly opposes efforts to deny birthright citizenship, a constitutional right under the Fourteenth Amendment. President Trump’s recent Executive Order, which attempts to revoke this right for children born to noncitizen parents, is unconstitutional and has been blocked in federal court. Such a policy would harm children, families, and communities—particularly children of color and those in immigrant families—by increasing the risk of homelessness, denying access to essential services, and worsening outcomes in health, education, and economic security. CLASP urges policymakers to uphold the Constitution and protect all children’s right to thrive.
